Terms of service

1 Purpose and background
1.1 These terms of use ("Terms of Use") apply to the use of the website archouse.dk ("Website"), which is provided by Unity Aarhus ApS, CVR no. 12580290, C/O Cobblestone A/S, Gammel Køge Landevej 57, 3rd floor, 2500 Valby, Denmark ("archouse Aarhus"). The Website may be used for mandatory payments under your tenancy agreement and payment of extra services including, but not limited to, internet, parking, sauna, storage rooms and ordering extra access cards and reservation of room/facilities in the property Gøteborg Allé 6, 8200 Aarhus N (the "Property").
1.2 The Terms of Use apply solely to the use of the Website and purchase of extra services and do not amend the rights and obligations pursuant to your existing tenancy agreement.
2 Conditions for the use of the Website
2.1 To use the Website, you must ensure that you have a functioning device through which you access the Website, and that you have an internet connection. Payments through the Website are made using either a credit or debit card accepted by the Website, via an external PCI-certified server.
2.2 All prices and fees listed on the Website include all applicable taxes and charges, including VAT.
2.3 You may only use the Website for its intended purposes. You must not isolate an individual component of the Website or incorporate it into your own or others' programs or software or exploit it in any other way for purposes other than those intended. You must not assist, encourage, or authorize third parties to modify, reverse engineer, decompile, or disassemble the Website or parts of the software therein, either in whole or in part, or create derivative works of the whole or parts of the Website.
2.4 You must not manipulate transactions made via the Website in any way or use the Website in violation of applicable laws and/or allow or contribute to others doing so.
3 Payments
3.1 When you make payments via the Website, you will be asked to enter your payment details for the transaction. Your payment details are stored and kept by the Website on a secure, external, PCI-certified server. The Website uses the 3 digits on the back of your payment card as a code to secure payments via the Website.
3.2 archouse Aarhus will ensure that all information sent between the Service and the server is encrypted. archouse Aarhus is not responsible for any claims resulting from the misuse of your payment card, where this is due to you not having stored your payment card securely.
3.3 When using the Website for recurring payments of mandatory payments under your tenancy agreement or payments of ongoing extra services, you may at any time terminate the payment agreement for convenience by deleting the payment agreement via the Website. You should notice that this does not constitute a termination of your tenancy agreement or agreement concerning ongoing extra services.
3.4 If you terminate your tenancy agreement for convenience, you are at the same time automatically terminating your payment agreement for convenience for mandatory payments under your tenancy agreement so that the payment agreement terminated on the same day as the tenancy agreement.
4 Conclusion of agreement concerning extra services
4.1 Agreements concerning extra services are concluded through archouse Aarhus' smartphone application (the "App").

4.2 The extra services displayed and offered on the App do not constitute a binding offer to enter into a purchase agreement, but rather an invitation for you to submit a binding purchase offer.
4.1 To submit a binding purchase offer to archouse Aarhus, you must select the service you wish to purchase and then fill in the information that appears on the order page.
4.2 Before you finally submit a binding purchase offer on the App, you have the opportunity to review and correct your entries. Here, you also have the opportunity to save your entries.
4.3 Your purchase of a service is only binding once you have received an order confirmation on the App (the "Order Confirmation"). The sending of the Order Confirmation constitutes archouse Aarhus' acceptance of your binding purchase offer.
4.4 The order confirmation contains information about the service you have purchased as well as any additional instructions.
4.5 The agreement between you and archouse Aarhus may be concluded in Danish or English. The agreement is stored by archouse Aarhus on the App.
5 Termination of agreement concerning extra services
5.1 For ongoing extra services which is not included in your tenancy agreement, including rental of storage rooms in the Property, the agreement remains valid until terminated by you or archouse Aarhus.
5.2 An agreement for ongoing extra services can be mutually terminated with 1 months' notice to the end of a month.
5.3 If the tenancy agreement between you and archouse Aarhus is terminated without separate termination of ongoing extra service(s), this is also considered a termination of such ongoing extra service(s), provided however that the ongoing extra service(s) is/are terminated effective same day as the tenancy agreement terminates.
6 Storage Rooms
6.1 When renting a storage room in the Property, you obtain the right to use a numbered storage room in accordance with the Order Confirmation. The right of use is paid for in advance on a monthly basis.
6.2 The size of the rented storage room and the monthly price is specified in the Order Confirmation.
6.3 Upon returning the storage room, it must be in the same condition as when it was taken over. Any keys must be returned to archouse Aarhus no later than at the expiration of the rental term.
6.4 When renting a storage room, you are obligated to follow archouse Aarhus' in force at any time guidelines for use of storage rooms.
6.5 In the event of violation of the guidelines, archouse Aarhus may refuse you continued access without entitling you to refund of the remaining rental term.
7 Sauna
7.1 Purchase of access to the sauna grants access to the use of the sauna in the Property during the time period(s) specified in the Order Confirmation.
7.2 When using the sauna, you are required to follow archouse Aarhus' in force at any time guidelines for the use of the sauna in the Property.
7.3 In the event of violation of the guidelines, archouse Aarhus may refuse you continued access without entitling you to refund of the remaining rental term.
8 Extra keys/access card
8.1 When renting extra key(s) and/or access card(s), the extra key(s) or extra access card(s) will be delivered no later than 14 days after you receive the Order Confirmation.
8.2 Upon termination of the rental agreement regarding rental of additional keys and/or access card(s) between you and archouse Aarhus, you are required to return the extra key(s) and extra access card(s) as soon as possible.
8.3 If a key or an access card is lost, you are required to immediately inform archouse Aarhus. In case of loss of keys or access cards, archouse Aarhus is entitled to charge a fee of DKK 100.
9 Participation in events
9.1 When purchasing access to events, you gain access to participate in the specific event as stated in the Order Confirmation.
9.2 During the event, you are required to follow the instructions of archouse Aarhus' staff as well as archouse Aarhus' guidelines for participating in events.
9.3 If an event for which access has been purchased is not held, archouse Aarhus is obligated to refund the payment already made for participation in the event.
9.4 In the event of violation of the guidelines and the staff's instructions, archouse Aarhus may refuse you continued access without entitling you to refund.
10 Booking of meeting rooms
10.1 When booking meeting rooms in the Property, the time period and meeting room number are specified in the Order Confirmation.
10.2 When using the meeting rooms, you are required to follow archouse Aarhus' in force at any time guidelines for the use of meeting rooms.
10.3 In the event of violation of the guidelines, archouse Aarhus may refuse you continued access without entitling you to refund of the remaining rental term.
11 Access to the Website
11.1 archouse Aarhus operates the Website with the aim of providing you with constant access. However, you acknowledge that archouse Aarhus is not obligated to ensure that the Website is continuously available, and archouse Aarhus will not be liable if access to the Website is interrupted without notice, e.g., due to maintenance or outages.
11.2 You are responsible for acquiring, installing, maintaining, and updating all connection equipment necessary for you to access and use the Website and its functionalities, and for ensuring that your use of the Website complies with the Terms of Use.
12 Intellectual property
12.1 All patents, trademarks, service marks, designs, utility models, unregistered trademarks, business or trade names (including internet domain names and email addresses), copyrights (including copyrights in broadcasts, computer software, and databases), semiconductor topography rights, database rights and design rights, inventions (including improvements to or additions to inventions), discoveries, know-how, and any other/all intellectual and industrial property rights and rights of a similar or equivalent nature ("Intellectual Property Rights") on the Website, including archouse Aarhus' brand, logo and expressions, community features, underlying software and technology, as well as all information, user data, and other material generated as part of the operation of the Website, belong to archouse Aarhus or archouse Aarhus' licensors. You do not acquire any claim to any rights, title, or interest in the same, nor will any goodwill accrue to you by virtue of your use of the Website.
13 Liability
13.1 The parties' liability to each other in the event of death, personal injury, deliberate misinformation, or other liability that cannot be disclaimed by mandatory law is not limited.
13.2 Subject to clause 14.1, archouse Aarhus' liability to you in any respect is limited to the possible extent, meaning that this disclaimer applies with the limitations that follow from mandatory law.
14 Other terms
14.1 archouse Aarhus may from time to time change the Terms of Use. The currently applicable Terms of Use can be found at archouse.dk. If the Terms of Use are amended, you may be obligated to accept the new terms of use to use the Website.
14.2 If one or more of the terms in these Terms of Use are deemed invalid or otherwise unenforceable, the relevant term(s) shall not be considered part of the Terms of Use, without affecting the validity and enforceability of the remaining part of the Terms of Use.
15 Right of withdrawal and defects
15.1 When you purchase goods/extra services from archouse Aarhus, you have a 14-day right of withdrawal. To provide your clear and unequivocal notice of withdrawal, you can fill out and send the standard withdrawal form, which can be found here: www.archouse.dk.

15.2 If the delivery of a service begins within 14 days, you can only withdraw from the part of the service that has not been delivered.
15.3 If you exercise your right of withdrawal in this agreement, we will refund you all payments received from you, minus the value of the delivered part of the service or the depreciation of the purchased goods, without undue delay and in any event no later than 14 days from the date on which we received notification of your decision to withdraw from this agreement. We will carry out such a refund using the same means of payment as you used for the original transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the refund.
15.4 If you purchase goods from archouse Aarhus, the rules on defects in the Danish Sale of Goods Act may apply.

17 Choice of law and dispute resolution
17.1 The Terms of Use are governed by and shall be interpreted in accordance with Danish law. However, Danish international private law rules shall be disregarded to the extent these rules are non-mandatory.
17.2 Any dispute related to the Terms of Use, including disputes regarding the existence or validity of the Terms of Use, shall be brought before the Danish courts.

19.1 You have the option to complain about goods/extra services provided by archouse Aarhus to the Centre for Complaint Resolution at www.forbrug.dk or via the European Commission's online dispute resolution platform at www.ec.europa.eu/consumers/odr.
